If any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable for any reason, in whole or in part, then that provision shall be severable from these Terms and Conditions and shall not affect the validity or enforceability of the remaining provisions. Conflicts between these Terms and Conditions and the specific terms and conditions of any other agreements relating to JWW Services Inc. accounts, products, and services, shall be controlled by the specific terms and conditions of the other agreements.

Section 2: Disputes

PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS A BINDING ARBITRATION CLAUSE THAT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIM(S).

Resolution of Claims or Disputes
2.1 Any dispute or claim between you and us arising in any way out of the use of our websites, the use of any product contained within our websites, or any communication you have with us will be resolved by BINDING ARBITRATION, rather than in a court. This applies to any and all claims, disputes, or controversies of any nature whatsoever that you may raise against us. This obligation applies to both parties, regardless of the legal theory or cause of action involved (tort, product liability, misrepresentation, negligence, etc.). Both you and us agree to waive the right to bring a lawsuit to be decided by judge or jury regarding any such claims or disputes, and instead agree to have such claims or disputes resolved by an arbitrator.

Governing Law
2.2 The arbitrator shall be agreed upon by the parties and the arbitration shall take place in Harford County, Maryland in accordance with Maryland law. 

Procedure
2.3 If the parties cannot agree on a mutually acceptable arbitrator, the arbitration will be conducted through the American Arbitration Association ("AAA") and in accordance with its rules. The AAA’s rules are available to view at https://www.adr.org. Both parties agree to equally share the administrative expense of the arbitration, unless the arbitrator finds that the claim was brought in bad faith and orders one party to pay the cost of the proceedings as part of the arbitration award. Both parties are responsible for paying the costs of their own counsel, experts, and witnesses. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Before commencing an arbitration under this Agreement, the aggrieved party will first present the claim or dispute to the opposing party by (certified mail, regular mail). Our notice address to submit claims or disputes is: JWW Services Inc., 217 E. Jarrettsville Rd., Suite 5, Forest Hill, MD 21050.

2.4 If the claim or dispute is not resolved within 90 days, the aggrieved party can commence arbitration proceedings in accordance with this Agreement.

Class Action Waiver
2.5 All arbitrations conducted under this Agreement shall be conducted only on an individual (and not a class-wide) basis; and an arbitrator shall have no authority to award class-wide relief. By agreeing to this Agreement, you acknowledge that this Agreement specifically prohibits you from commencing arbitration proceedings as a representative of others or joining in any arbitration proceedings brought by any other person.  

Section 3: Additional Terms

Product Warranty
3.1 Unless otherwise specified on the product page of the VeneerSupplies.com website our products, excluding adhesives, are warranted to be free from defects in material and workmanship for a period of thirty days from the date of delivery. During this term, we will repair or replace any part of the product that fails to conform to the applicable warranty. The defective part must first be returned pre-paid within thirty days of the request for warranty resolution.

3.2 This warranty made in lieu of all other warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and/or fitness for a particular purpose, which we hereby disclaim. We shall not be responsible for repairing or replacing a product under this warranty unless the customer notifies us in writing of warranty claim within thirty days of the date of delivery of the defective product. No warranty of any kind is made, or shall be imposed, with respect to the product which in the judgment of JWW Services Inc. has been subject to misuse, negligence, or accident; or industrial, institutional, or heavy commercial use; or altered or repaired by anyone other than our authorized representatives.

3.3 In no event shall we be responsible for any costs for repairs or replacements not authorized by us, or for incidental damages, consequential damages, or loss of use for any reason including, but not limited to, economic losses or other business expenses or costs resulting from a warrantable failure.

3.4 The customer's exclusive remedy pursuant to this warranty is restricted to repair or replacement of the product in the event of a defect or warrantable failure in any part of the product. In no event can the customer or any beneficiary recover consequential damages, or economic loss from us. We may opt to provide a refund in lieu of warrantable repair or replacement. It is our sole discretion to offer this remedy. Said refund shall not exceed the purchase price of the product. We will not be liable for refunding shipping fees, handling fees, brokerage fees, customs charges, payment processing fees, or any other expense.

3.5 In no event shall we be responsible for bodily harm, incidental damages, consequential damages, or loss of use for any reason including, but not limited to, economic losses or other business expenses or costs resulting from failure of the adhesive to bond as intended.

3.6 In regard to product warranty for orders shipped outside of the US, the defective part must first be returned pre-paid within thirty days of the request for warranty resolution. The customer shall be responsible for all shipping costs associated with the replacement part.

3.7 The parties agree that these terms satisfy the essential purpose of the warranty, and that this warranty shall not apply if customer has failed to comply with any material term or condition under this warranty.

Adhesive Product Non-Warranty
3.8 Due to the multitude of circumstantial methods, conditions and environments in which an adhesive product can be used, our adhesive products come without warranty. Our only obligation shall be to replace an adhesive product proven by us to be defective. We may also opt to provide a refund in lieu of replacement. It is our sole discretion to offer this remedy. Said refund shall not exceed the purchase price of the product. We will not be liable for refunding shipping fees, handling fees, brokerage fees, payment processing fees, customs charges or any other expense. User accepts the adhesive product as-is and without warranty expressed or implied. The suitability of the adhesive product for any use shall be solely at the user's discretion. If the user does not accept these terms, the unused product is to be returned prepaid within thirty days of receipt for a refund, where applicable. Please note that some items can not be refunded.

Shipments to Freight Forwarding Companies
3.9 We will not knowingly ship to freight forwarder or product transfer service provider. We may unknowingly ship a product or products to this type of service provider and in such event, any warranty expressed or implied is thereby waived and made invalid. Additionally, we accept no liability for any product damage or missing parts for orders shipped to a freight forwarding company.

Intended and Expected Product Use
3.10 Our veneers are not suitable for exterior use. Our veneers are only for use within interior conditioned spaces where the project is not exposed to water, excessive temperatures (including fire), or electrical hazards. We do not recommend or warrant our veneers as suitable for use as lamp shades or similar projects, or without the use of a suitable and stable substrate. The intended and expected use of our veneers does not include use on translucent substrates or projects where no substrate is used, and because of this we do not warrant our veneers against defects that are easily repaired when applied to a standard substrate.

3.11 Under no circumstance should our products be used for any type of structural application or other application where your safety, the safety of others, and surrounding property could be endangered by failure of the product.

3.12 Our products are not intended for institutional, industrial, or heavy commercial use.

Production and Transit Times
3.13 The production and processing lead times shown on our site are estimates only and as such are not guaranteed. Transit times quoted by us or suggested by any information on our site are based on the best available information and are not guaranteed accurate.

Website Content and Instructions Waiver

All content provided is opinion only (which is subject to change) and offered without warranty. Product labels and directions for use are provided without warranty. We shall have no liability for the content of the labels and directions for use, and all such content being accepted and used at your own risk. You are solely responsible for your use of and reliance on any content provided within the labeling and directions for use. You must conduct any necessary, appropriate, prudent, or judicious investigation, inquiry, research, and due diligence with respect to any content found on the labels and directions for use. You agree to indemnify and hold JWW Services Inc. harmless from any and all actions, civil or criminal, claims, liabilities, and losses including our attorney fees, arising from the product label content and directions for use. Furthermore, the label content and directions for use have been written without taking into account your ability to work safely; nor does it account for any specific project situation, objectives, or needs. Before acting on any information found on our product labels and directions, you should consider the appropriateness of the content, as well as your ability to understand the directions and safely follow those instructions with regard to your project situation, objectives, and needs.

3.16 We shall not be held responsible for errors or omissions including but not limited to typographical errors. We shall attempt to provide labels and directions for use as we see fit. However, due to the variety of products we offer and the myriad situations in which these products can be used, handled, and stored, it is understood and agreed that we cannot include labeling, directions, and/or warnings for every product or that any label, direction for use, and/or warning covers a complete list of unwanted or harmful possibilities associated with the handling, storage, and use of the product. You agree to exercise care and act responsibly in the use, handling, and storage of the product regardless of the content of any label, direction for use, or lack thereof.

Communication Waiver of Liability
3.17 All communication with us, including but not limited to that which is conveyed via email, shall be considered that from a non-expert. Verbal and written comments, suggestions, instructions, drawings, diagrams, pictures, and other forms of communication provided by us are to be considered non-expert opinion only (which is subject to cchange) and are offered without warranty. While we are happy to furnish non-expert advice, it is understood and agreed that such advice is given for no consideration and we shall have no liability for any information we provide or the results/outcome obtained, and all such advice being accepted and used at your own risk. Under no circumstance do we act as your consultant. You are solely responsible for your access to, use of and/or reliance on any form of communications with us. You agree that you will not act upon any communication with us until you have conducted any and all necessary, appropriate, prudent, or judicious investigation, inquiry, research, and due diligence. You agree to indemnify and hold JWW Services Inc. and its owners harmless from any and all actions, civil or criminal, claims, liabilities, and losses including our attorney fees, arising from a verbal or written suggestion, comment, or instruction from anyone employed by or representing VeneerSupplies.com/JWW Services Inc. Additionally, email transmission cannot be guaranteed to be secure or error-free as information could intercepted, corrupted, lost, destroyed, arrive late, or arrive incomplete.

Accuracy and Changes
3.19 The information provided on the JWW Services Inc. websites which includes, but is not limited to VeneerSupplies.com and JoeWoodworker.com, are believed to be complete and up-to-date but are not warranted as such. We reserve the right to modify the information on our web sites at any time without notice. Any such modification shall be effective immediately upon posting and your continued use of this website shall indicate your acceptance of these changes.

Product Purchase Limits
3.20 We reserve the right to limit the quantity of items purchased per person, business, household, order, credit card, and/or IP address. We will contact you in the event that you have ordered more product than can offer due high demand or limited supply.

Product Reviews
3.21 We reserve the right to assess product reviews for content and authenticity, and to disallow any product review containing false, unhelpful, ambiguous, abusive, misleading, confusing, or inappropriate content. We also reserve the right to decline posting a review that indicates the misuse of the product or a failure to follow the product instructions. To maintain the highest level of legitimacy and reliability of content on our site, we will not publish product reviews written by non-customers, or by customers who have not purchased the product for which they have written a review. Product reviews containing the name of (or containing a reference to) the name of competing product or manufacturer will not be posted. Sales Tax
3.26 Online businesses are subject to the same sales tax collection requirements as any other retailer. Internet retailers such as VeneerSupplies.com are required to collect taxes on behalf of any jurisdiction in which federal or state laws require it regardless of where the business may be physically located. Section 4: Product Exportation and International Orders

4.1 Our products may be subject to export controls administered by the United States. You agree to comply with all United States export laws and regulations, and shall not allow any third-party to remove or export from the United States or allow the export or re-export of any part of the products or any direct product thereof: (i) into (or to a national or resident of) any embargoed or terrorist-supporting country; (ii) to anyone on the U.S. Commerce Department’s Table of Denial Orders or U.S. Treasury Department’s list of Specially Designated Nationals; or (iii) to any country to which such export or re-export is restricted or prohibited, or as to which the United States government or any agency thereof requires an export license or other governmental approval at the time of export or re-export without first obtaining such license or approval.

4.2 Our products may not be diverted or otherwise shipped to another destination that does not fully comply with US laws and the laws of any other applicable jurisdiction.

4.3 We do not provide HTS or tariff codes. Customer shall assume sole responsibility for any required export and import approval documents and/or licenses. We do not and will not provide NAFTA/USMCA documents, health certificates, safety documents, certificate of origin documents, or any data documents related to the importation of our product into your country.

4.4 The customer shall be solely liable for all costs related to any violation of a United States export law or regulation as well as any other law or regulation of an applicable jurisdiction at the receiving country.

4.5 The shipping charge amount which is displayed and collected when you checkout on our website is not inclusive of any customs charges, duties, taxes, or brokerage fees. These charges are invoiced by and payable to the carrier and are due upon delivery.

4.6 In regard to product/order returns, we will not refund our incurred fees associated with any international order in which the customer made payment using the PayPal service. These fees, which we cannot reclaim, are fully earned by PayPal when the payment transaction takes place.

4.7 We will provide warranty support in the event that our product fails to perform during its warranty period. The defective part must first be returned pre-paid within thirty days of the request for warranty resolution. The customer shall be responsible for all shipping costs associated with the warrantable part.

Section 5: Fees

Shipping Address Corrections and Changes
5.1 Our primary shipping carrier charges us a $22.50 address correction fee (per box) for shipments in which the customer has entered an invalid or incomplete shipping address. In this event, we will contact the customer up to two times via email if the shipping carrier identifies and adjusts an error or omission in the customer-provided shipment information. If the correction is deemed valid or if the customer does not reply to our email request for address clarification within 5 business days, a fee of $22..50 per box will be charged to the customer's credit card.

5.2 You agree to reimburse us for any charges on our shipping carrier invoice which are associated with any correction, update, or other change you may make to the shipping address when contacting the shipping carrier.

Order Changes
5.3 If we receive your request to add, remove, or change the quantity of an item in your order before it has been packed, we will gladly work with you to make any order modifications. We charge $4.95 to cover the time and expense of changing your order and completing the additional payment process and paperwork.

Order Cancellation
5.4 Orders cancelled by the customer are subject to a $4.95 fee to cover our costs/fees associated with the order cancellation and refund process. For international orders where PayPal is used to pay for the order, it is important to note that the PayPal processing fees we incur from your payment are not refunded to us by PayPal and thus are deducted from your refund amount.

Refused Shipments
5.5 Orders that are refused upon delivery and returned to us by the carrier will be refunded minus a 20% restock fee. We will also deduct the outbound and return shipping cost from the refund amount.

Replacement Invoice
5.6 A service fee of $4.95 will be charged to fulfill requests for a copy or copies of an order invoice.

Section 6: Product Return, Missing Item, Damage Claim, and Package Loss Policies

6.1 Our returns policy can be found by clicking here.

6.2 Returned items that qualified for free or discounted shipping will have the shipping and packaging expenses deducted from the refund amount.

6.3 We shall not be held responsible or liable for any shipment that is damaged or missing items unless you notify us by email within 10 days from the date your package was delivered.

6.4 You agree to notify us within 30 days of submitting your order on our website if your package was not delivered to, or was delivered but not found at, the address you provided. Your prompt notification of such issue allows us to work with the carrier to investigate and if possible, retrieve and re-deliver your package. The failure to notify us within this time frame absolves us of all responsibility for the receipt of your shipment.

6.5 We will not provide replacement, refund, reimbursement, or other compensation for any package stolen at/from the delivery location. Our responsibility for the delivery of your package terminates if the shipping carrier deems the package to have been delivered to your shipping address. Upon your request, we will provide a copy of your invoice and payment receipt so that you can notify your local police department and if possible, file a claim with your property insurer.

6.6 We shall not be held responsible or liable for any damage or loss including misdelivery if you have a release signature on file with the shipping carrier and have arranged for packages to be left at your designated receiving address without your signature. By authorizing the shipper's use of your release signature on file, you indemnify us and you accept the entire risk of damage or loss. It is thereby your responsibility to file a loss claim with the carrier and pursue reimbursement through them.

We have established the privacy policy so that you can understand the care with which we intend to treat your personal information.

7.3 We may opt to contact you by phone and/or email to follow up on your order and ask if you are satisfied with our service and products. By ordering on our website, you approve of this communication and you agree that it is acceptable to contact you in this manner and for this purpose. You hereby agree that this form of follow up communication shall not be construed or considered unsolicited/unwarranted.

This data includes, but is not limited to, a first and last name, a home or other physical address and an email address or other contact information, whether at work or at home. 7.5 We may post on our website or other public forum the content of any message you send us. 7.7 Packages for your order(s) which are shipped from our warehouse in Maryland typically contain a printed copy of your invoice. The invoice may include personal private information such as your name, phone number, billing address, shipping address, email address, and more. The printed copy of your invoice also includes the name of the item(s) you have ordered as well as the cost of each item, the cost you paid for shipping, any sales tax amount you may have paid, and the total cost for the order. By ordering on our website, you agree to allow us to include a copy of your invoice with your shipment.

Section 8: User Submitted Images

8.1 Photographs, images, drawings, renderings and the like (herein "image" or "images") which are submitted to any email address at VeneerSupplies.com, JoeWoodworker.com, or any JWW Services Inc. website via direct email or through the submitting of a contact form are subject to the follow conditions.

  • All images submitted by you to us shall become our property for use at our sole discretion.
  • You understand and agree that we may use, edit, transmit, publish, or make derivative media of any image that you submit to us for any purpose without any form of recognition, compensation, or communication to you.
  • You understand that we may use your first name, last name, business name, city, and state in conjunction with any image you provide to us.
  • You understand and agree that any image you submit to us may be removed from our sites and servers at our discretion for any cause or reason. You may contact us in writing if you wish to request the removal of the image and we shall attempt to honor this request within 10 business days.
  • You hereby waive any and all privacy expectations that you may have with respect to any such images submitted to us by you.
  • By submitting an image, you hereby warrant and represent that the submitted file does not infringe on any copyright or trademark, any rights of privacy or publicity of any person, or any other right of any third party.
  • You further understand and agree that any image submitted to us by you may be available for downloading, viewing, reviewing, and commenting by the public.
